When living in an apartment, you become de facto a member of a co-ownership syndic, which shall elect a syndic who will be in charge of managing all the services of the concerned property. The same principle applies for the buildings sheltering office spaces.

The services falling under the responsibility of the syndic may include the good running of installations like the pumps, generators, lifts, the complex’s green spaces maintenance or even security in some cases. If the services of the syndic are not equal to promises, the co-ownership syndic may intervene. Day value, most of the complexes under the co-ownership management are for residential purposes.
“A syndic’s job is somehow similar to a doctor’s. He must be available 24/7 or delegate someone to replace him as he is responsible of the managed co-ownership’s comfort. Many of those services depend on a safe co-ownership’s finances management. _A syndic may also have legal responsibilities such as tender specifications or co-ownership regulations, depending on the type of building under management.
“Every individual/ family/ enterprise being part of the co-ownership must pay common fees. Otherwise, the syndic may invoke the law to obtain those fees. In extreme cases, the property may be sold at auction.” Adds Symon Lutchmaya.

Who may become a syndic?

Anybody can act as a syndic, indicates our speaker. He may be proposed by a syndical council member, but must be elected by a majority of 50% of the co-owners. It is to be noted that the residents having the greatest shares in the co –ownership will benefit from more influence in the choice of syndic.
Several qualities are required to exercise the role of syndic, namely a basic knowledge about electrical engineering, plumbing, accounting and Civil Code in relation to the co-ownership. The syndic must also be a good team leader and communicator as he must manage the staff assisting him, preparing a yearly statement of expenses and draft administrative letters. Important fact to underline: the syndic is solely concerned by common aspects of the building. The apartment’s interior or the office spaces is no concern to him. This falls under the resident’s responsibility.
